Terms and Conditions for Spark

Introduction
Welcome to Spark, a digital service platform designed to facilitate brand partnerships within Discord communities. Spark is owned by Certainly Stuff Ltd, trading as Wildfire ("Wildfire", "we", "us", or "our"), accessible via getwildfire.gg. By signing up to use the Spark platform ("Service"), you, the Discord community administrator ("you" or "your"), agree to be bound by these terms and conditions ("Terms").
Google Authentication and Communications
By logging in through Google Authentication, you consent to:
- Wildfire accessing your basic profile information for registration and verification.
- Receiving emails about product updates, campaigns, and service announcements.
- You may opt out of non-essential communications at any time.
Services Offered
Spark provides tools and services for managing and executing advertising campaigns within Discord communities. This includes but is not limited to:
- Contextual categorisation of communities for relevant offers.
- Partnership offers to your e-mails.
- Live chat within Spark for communication.
- Perks for community managers to take advantage of.
Tracking
By installing the Wildfire bot on your server and granting the required permissions, you agree to the following:
- Wildfire will collect and process only the data required to provide brand partnership opportunities.
- No scraping, unauthorized data collection, or storage of individual user data will occur.
- Wildfire's actions comply fully with Discord's Developer Terms of Service, and no user-specific data will be shared, stored, or used for targeting purposes.
User Obligations
Account Registration
You must provide accurate, complete, and current registration information and maintain the security of your account credentials.
Legal Compliance
You agree to use the Service in accordance with all applicable laws, rules, and regulations, as well as Discord's Terms of Service and Developer Policies.
Pricing and Payment
The following payment terms apply to all advertising campaigns:
- Fees: All fees are paid once Wildfire has been paid by our clients.
- Prize Funds: Disbursed on the Thursday following the campaign Start Date.
- Invoice Submission: Payment processing requires submission of a complete campaign report, including the invoice, through the designated reporting field.
Advertising Materials
Advertisers must provide all necessary creatives, tags, and materials required for campaigns.
Community owners must manually post all campaign content. The Spark bot never posts branded content or any content in servers.
Reporting Requirements
Communities must submit screenshots documenting all posted campaign materials at key points during the campaign.
Communities agree to complete the Wildfire reporting form, including invoice submission in the designated field, as a condition for payment.
Cancellation
Either party may cancel this agreement with written notice at least three (3) days before the campaign start date.
Cancellations after the start date require advertiser payment for any delivered ad inventory.
Delivery
Communities commit to fulfilling all campaign deliverables in good faith and without undue delay.
Failure to meet deliverables within the specified timeframe may result in reduced compensation.
Non-Circumvention
To protect Wildfire's business interests and operational integrity, you agree to the following:
- You will not directly or indirectly engage, solicit, negotiate, or contract with any advertiser introduced to you through Spark or via a Wildfire representative for a period of two (2) years without Wildfire's written consent.
Non-Disclosure
- Confidential Information: You acknowledge that you may access confidential information through Spark. You agree not to disclose or use such information outside the scope of these Terms without prior written consent from Wildfire.
- Safeguarding Information: You agree to protect confidential information from unauthorized use, disclosure, or theft.
Intellectual Property Rights
All rights, title, and interest in and to the Spark platform, including all intellectual property rights, are and will remain the exclusive property of Certainly Stuff Ltd and its licensors. No rights are granted to you other than as expressly set forth in these Terms.
Limitation of Liability
To the maximum extent permitted by applicable law, Wildfire and its affiliates, officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or related to your use of the Service. Wildfire's total liability for any claim under these Terms shall not exceed the total amount paid by you to Wildfire, if any, in the 12 months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Wildfire, its directors, officers, employees, and agents from any claims, damages, obligations, losses, liabilities, or expenses arising from your use of the Service or violation of these Terms.
Termination
Wildfire reserves the right to terminate your access to the Service at any time, without notice, for any reason, including violation of these Terms or Discord's Developer Policies.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Modifications to Terms
Wildfire reserves the right to modify these Terms at any time. Changes will be communicated with due notice, and continued use of the Service constitutes acceptance of the updated Terms.

Brand Safety
- Community must block commonly flagged words, and have 'Severe Profanity', 'Insults & Slurs', and 'Sexual Content' all ticked to block.
- By accepting this contract, Community agrees to fulfil the deliverables above in good faith and not hold back delivery for any reason within its powers.
- If deliverables are not met within the campaign timeframe as prompted by the Advertiser, the Community may be entitled to reduced compensation
Ad Materials
- Advertiser shall provide all necessary ad creatives, tags, or any other materials required for the execution of the campaign.
- Community must submit all content themselves/through a community manager, not through the use of a bot.
- Community must only post content that has been approved by Wildfire.
Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severed from these Terms and shall not affect the validity and enforceability of the remaining provisions, which shall remain in full force and effect. Where permissible, a valid, enforceable provision that most closely matches the intent of the original provision shall be substituted in its place.
Data Protection and Privacy
We take data protection seriously. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you also agree to our Privacy Policy.
