Terms of Service

These Terms of Service ("Terms") govern your use of the Spark campaign management platform ("Spark", "the Platform") operated by Certainly Stuff Ltd, trading as Wildfire ("Wildfire", "we", "us", "our"). By accessing or using Spark, you agree to be bound by these Terms.
1. Acceptance of terms
By creating an account or using Spark, you confirm that you have read, understood, and agree to these Terms. If you are using Spark on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
If you do not agree to these Terms, you must not use the Platform.
2. Account responsibilities
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to:
- Provide accurate and complete information during registration
- Keep your login credentials confidential
- Notify us immediately of any unauthorised access to your account
- Not share your account with others or create multiple accounts
3. Permitted use
Spark is a business-to-business platform designed for campaign management and community engagement. You may use Spark to:
- Create, manage, and track brand campaign activations
- Connect brands with gaming and entertainment communities
- Submit and review campaign content and deliverables
- Track campaign performance metrics and generate reports
- Communicate with other platform users regarding campaigns
- Process and track campaign payments and earnings
You must not use Spark to:
- Engage in any unlawful, fraudulent, or deceptive activity
- Submit false or misleading campaign data or metrics
- Attempt to access data belonging to other users or organisations
- Interfere with the operation or security of the Platform
- Scrape, harvest, or collect data from the Platform by automated means
4. Content ownership
You retain all intellectual property rights in content you submit to Spark, including campaign briefs, creative assets, brand materials, and community content.
By submitting content to Spark, you grant Wildfire a non-exclusive, worldwide, royalty-free licence to display, distribute, and process that content solely for the purpose of operating the Platform and delivering campaign services.
This licence ends when you delete your content or close your account, except where content has been shared with other users as part of a campaign (in which case the licence continues for the duration of that campaign plus 12 months for reporting).
5. Payment terms
Campaign prizing and payments are processed in accordance with the deal terms agreed between the relevant parties on the Platform.
- Community payments: Earnings are paid per the deal terms agreed for each campaign
- Management fees: Wildfire management fees are charged per the agreement between Wildfire and the brand or agency
- Payment processing: All payments are processed through Stripe. Wildfire does not store payment card details
- Disputes: Payment disputes should be raised within 30 days of the payment date by contacting legal@getwildfire.gg
6. Limitation of liability
To the maximum extent permitted by law, Wildfire shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of Spark.
Our total aggregate liability for any claims arising under these Terms shall not exceed the fees paid by you to Wildfire in the 12 months preceding the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
7. Termination
Either party may terminate these Terms at any time by providing 30 days written notice to the other party.

- We may suspend or terminate your account immediately if you breach these Terms
- Upon termination, your right to use Spark ceases immediately
- We will retain your data in accordance with our Privacy Policy
8. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before the changes take effect. Continued use of Spark after changes take effect constitutes acceptance of the updated Terms.
9. Governing law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
